Privacy Policy

The information sharing practices described in this privacy policy apply to our current and potential customers, users of our Internet sites, recipients of surveys or marketing information.

However, these principles only apply to Tilefile. If, in using the Service, you disclose personal information to another user, you must be aware that Tilefile has no responsibility for that disclosure, or any use that the other user may make of your personal information. You must exercise care when disclosing personal information to others, and satisfy yourself that the other person will respect your privacy, and your personal information.

1. Collection and use

1.1 The company agrees to comply with the Australian Privacy Act 1988 (Privacy Act) and the National Privacy Principles (Principles) in respect of users’ private information provided to Tilefile. Without limitation, the Principles broadly require the following:

  • Notifying the users that Tilefile collects personal information from them (as requested from time to time by Tilefile and as volunteered by users) and what Tilefile will do with this information.
  • Tilefile will only use personal information about the users in ways that they give permission or that they might reasonably expect as part of the use or operation of the Service.
  • Disclose your personal information to other Tilefile users to allow those other users to locate and access content provided by you, and to use the Tilefile service.
  • Provide users the opportunity to see any information we hold about them if they request it.
  • Ensure that the users’ personal information is secure.
  • If our users ask, advise them how we handle their personal information within the business.

1.2 In addition, Tilefile may use personal information collected from users for any of the following purposes, without limitation:

• For aggregation with information of third parties for the proposes of providing an improved user experience on the Service
• To provide the personalised services and to satisfy customised user requests (such as, without limitation, to facilitate user targeted and content targeted and non-targeted advertising) including to third parties
• For the purposes of complying with legal obligations, preventing fraud, infringement of intellectual property rights or imminent harm, and to ensure the integrity and security of the Tilefile network and Service.

1.3 TILFILE agrees to take all reasonable steps to preserve the security of your private information.

1.4 Where possible, we will only collect personal information from a user. If we collect personal information from another person, we will take reasonable steps to notify you.

1.5 Tilefile also agrees to take reasonable steps to ensure that the personal information that is held is up to date and accurate.

1.6 However, you agree to indemnify, and hold harmless, Tilefile, its officers, employees and agents against all claims if your private information is used in a manner inconsistent with this Privacy Policy or the Principles by any third party to whom Tilefile provides your private information.

2. Your Choice

At Tilefile we welcome your comments and feedback on our Privacy Policy.

You can contact us at any time with any inquiries or complaints you may have concerning your private information.

Tilefile agrees to make in good faith all efforts to deliver you reasonable access to your personal information upon written request (including by email). Also, if you believe that any personal information that we hold about you is inaccurate, you are able to request that the record is corrected. We will consider any request that is made, and will explain any reasons why we may decline to make a requested correction.

We may charge you a reasonable fee for access to your personal information. We expect that this fee will approximate our actual costs of providing access to you.

If you choose to decline to provide Tilefile with certain personal information when requested by the Service (such as, without limitation refusing cookies in your browser), the Tilefile experience and features may not operate optimally or at all.

While an authorised user of the Service, you agree to be bound by the terms of this Privacy Policy. You are free to revise or withdraw your consent at any time to these terms by terminating your membership of the Tilefile Service in accordance with the Tilefile Agreement.

3. Enforcement

If we fail to comply with this privacy policy or otherwise comply with the Principles we encourage you to tell us about the failure to comply and to be as specific as possible so that we can resolve any dispute between us. The terms of the dispute resolution procedure in the Tilefile Agreement will apply.

4. Advertising

You agree that Tilefile may display targeted and non targeted advertising on the Service.

Targeted advertising includes the correct context advertising and Tilefile will endeavour to make the targeted advertising within the correct context based upon user generated keywords, tags and content. However, ultimately accuracy of any context advertising depends on the accuracy of information provided by the user who created the content. Tilefile assumes no liability for incorrect context in anyway and has no liability in this regard. Tilefile expressly disavows any and all representation, warranties and claims as to, without limitation, fitness for purpose, merchantability or quality of any goods and service which may be displayed in any advertising on the Service and, to the extent permitted by the law, you acknowledge that you have no entitlement to remedy or claim against Tilefile in respect of the accuracy, sufficiency or otherwise of any advertising or goods or services promoted or purchased through or using the Service.
